What is Zoning?

The delineation of districts and the establishment of regulations governing the use, placement, spacing, and size of land and buildings. Zoning provides guidelines for setbacks, height of structures, lot sizes, lot coverage, parking and other requirements. Zoning also regulates the types of land uses permitted on a property.

What would I need a zoning permit for?

You will need a zoning permit for: All structures, including but not limited to; single-family home, secondary dwelling, accessory building, home occupation’s, swimming pools, generators, solar panels, and decks.

Do I need a fence permit?

If you live within one of the 5 townships, you are not required to get a fence permit, but there cannot be a fence over 4 ft. tall in the front yard and/or a fence over 6 ft. in the back yard. We do recommend when installing a permit, to keep the fence away of the property line so there is no trespassing on your neighbor’s property.

How do I locate my property lines?

To locate your property lines, you will need to have a survey done.

What does nonconforming mean?

A nonconforming use is a property use that existed prior to current zoning regulations and is allowed to continue under a grandfather clause; for example, a restaurant in a single-family residential neighborhood that existed prior to that neighborhood’s zoning designation. Nonconforming uses are sometimes allowed indefinitely, sometimes for a set period of time. Subsequent uses on the same lot are required to conform with zoning codes.

How do I call in to report a zoning violation?

Anyone can call in to the Warren County Zoning office to report a zoning violation that has anything to do with trash, debris, and junk vehicles. If it is a high grass complaint, the violation will need to go to the township they reside in. Be sure to have the parcel # or the address, so we can look it up.

How do I apply for a driveway permit?

You will need to apply through the Warren County Engineer’s office.

Where do I apply for a plumbing permit?

You will need to contact the Warren County Health Dept.

Where do I apply for a septic permit?

You will need to contact the Warren County Health Dept

Where do I apply for a site plan/ plot plan?

You will be able to get a copy of your site plan/ plot plan in the Warren County Map room.

What is my property zoned?

You can look up the zoning for a parcel, and find links to the County's Zoning Code and an explanation of the Code on our website. The Zoning Code contains a list of uses allowed in each zoning district, development standards such as setbacks, and information on permits required.

Can I change my parcel’s zoning?

Zone changes are possible; however, they require approval by the Rural Zoning Commission Board and may require an amendment to the Warren County Rural Zoning map, and will have the opportunity for public comment.

What are my building setbacks?

Building setback requirements vary depending on the zoning of your property. Call the Warren County Zoning office, to verify zoning for a specific parcel.

Can I live in a travel trailer on my property?

The Warren County Zoning code does not allow occupancy of a travel trailer on private property unless it is in a mobile home park or, for limited time periods, in a recreational vehicle park. However, a travel trailer can be used while a home is being built on the property. Please note the permit is only good for 6 months and the owner can only have two within a 12-month period.

Can I operate my business out of my home?

Yes, it will depend on what type of business on what you need to file for.

Does my proposed project require a public hearing?

All variances and re-zoning changes require public hearings before the Board of Zoning Appeals or the Rural Zoning Commission. You must have a consultation with the zoning staff to get started.

Can I build a secondary dwelling?

A secondary dwelling is a detached residential accessory structure limited to a maximum 1500 square feet in size and must share the same utilities and the same address. Any accessory structure must meet the development standards of the applicable zoning district.

Do I need a permit to install a patio?

If the patio is constructed of poured concrete or brick pavers, you do not need a permit

Do I need a permit for a shed?

If the shed is 200 sq ft or less, you will only need a zoning permit. Now if the shed is 201 sq ft or larger, then you will need to have a building and zoning permit.

What do I need to do to subdivide my land?

If the property is 5 acres or less, you will need to contact the Warren County Regional Planning Department. If the property is larger than 5 acres, we suggest meeting with our zoning department to eliminate any questions or concerns.

Isn’t my property zoned agricultural if I have CAUV on it?

No, your property is not zoned agricultural just because you have CAUV. The CAUV is a tax break given by the Auditors office, once you have met the qualifications. So, please contact the Auditors office with any questions.

Who enforces neighborhood covenants?

Warren County Zoning has no legal ability to enforce private covenants. The Homeowner’s Associations (HOA) are the ones that control and enforce the private covenants and restrictions in a neighborhood. The covenants will be located on the original plat.
